Johnson’s move to prorogue Parliament has proved to be incredibly controversial, so many are calling for it to be blocked. The problem is it’s not exactly clear who could stop prorogation or work around it’s restraints. In this video we discuss the options and if MPs, lawsuits or the Speaker John Bercow could stop prorogation.

    MPs could have passed legislation to take away the royal power to prorogue parliament just like they did with the royal power to dissolve parliament (which was taken away through the Fixed Term Parliament Act). It could've been done quickly just like the legislation to block no deal which was passed within a day.

    Unfortunately that hasn't happened so prorogation is now in effect.

    I suppose the Tower of London is still available for dealing with difficult characters in a manner which sends a clear message to one and all in the House of Commons if a deal is not reached by October 31st. Following the untimely passing of the PM under extrordinary circumstances a new Prime Minister should be selected requiring the vote of a majority from all parties of the House of Commons including at least one third of his own party, and one quarter of each of the other parties if that adds up to a majority so that true compromise and a degree of concensus would be needed. Behavior should be somewhat improved, it couldn't be any worse!

    I know a person who could stop prorogation:
    Elizabeth Alexandra Mary Windsor aka Elizabeth II, Queen of … a lot of islands all over the world

    But since she already signed off on it, taking back her word is even more unlikely than her not granting it in the first place. This would truly be revolutionary.

    I am not a UK citizen so I am more or less unfamiliar with the procedure, but couldn't parliament change the constitution and thereby say "Sorry queen not for you to decide anymore"?

    All ideas have just one flaw: Brexit hasn't progressed one bit and therefore the EU won't allow any more extension. Even if Parliament has more time to discuss, 3 years have shown that no progress won't be made. What was achieved with the latest extension until October? The only change was Johnson…

    UK is finished because of a few ridiculous mps going on record against the viable caretaker option over petty personal politics.

    I'm confused why they care about prorogation. They've had three years to decide a way forward, but haven't been able to, so what is it about an extra few days of debating that makes any difference?

    I mean, isn't prorogation as a concept just dumb as shit? "Pass a bunch of stuff that's terrible in the minds of most people, but plays to the exact right places to not be an issue, and in fact an advantage, next election, achieving this with promises to smaller parties on future votes for their stuff" -> "prorogue parliament until the next election so they can't vote no confidence".

    How great will it be when we're finally out. The EU lovers can bounce, brexiteers get our brexit and TLDR can look into alternative news.

    Every remainer I spoke to in person was excited at the thought of a free movement agreement between the English commonwealth countries.

    Parliament is not working is undemocratic it is against the will of the people due
    to remoaner MP's self interest and NOT representing and betraying their constituents and NOT respecting the democratic referendum result to leave the EU and undermining Democracy.
    The government has to implement what ever it takes to uphold democracy and leave the EU as instructed by the people and article 50 with a deal or no deal
    by 31st October.
    Dare to say the Disturbingly undemocratic serial remoaners are trying to stop brexit at any cost and Democracy and their actions will not be forgotten by their constituents.

    Why do re-moaners not understand that unless they actually go and negotiate themselves, manage to get a deal that means we actually leave all EU institutions, while securing free trade and an agreement that border systems stay as they are, that it will not please the population of the UK, or government. Boris Johnson is trying to do that and yet they want to legally override article 50 so that we don't leave, they wont advise the EU as to a deal that would please them while making sure the UK leaves and its not the current governments fault that the EU wont come to the table again. No deal is the only option we have, to force the EU to either collapse as an organisation, or on their position of actively opposing a solution that pleases both parties. The EU is showing itself to be the dictatorship that we want to leave and the re-moaners are bolstering their position.

    I like your presentations. Could you explain BREXIT in following terns. Person is coming with a nice Mini (EU membership) to a remote garage. Jolly employee (Farage, Johnson) offers him to trade his car for the Jaguar (Johnson, easy, have your cake and eat it Brexit) in the parking lot and some money too. Does he want to sell his Mini for 10.000 GBP to buy the Jaguar for 8000 GBP. He says sure. Better car (free trade, no obligations) and some money left (for the NHS) Then the garage owner (the EU) comes and says the Jaguar is not for sale. He can buy the old Rover but has to pay 15000 GBP for it. HE says no way, that is not the deal. But he "agreed to sell his Mini" (referendum) the employee says and now is being told he has the choice between buying the Rover (may's deal) or walking back (no deal brexit). Would you not like to say "forget it"and drive away in you r Mini. How do yu feel about the employee blocking your way out. What would you do?

    Brilliant Thanks In the US the leader of House / Senate decide when they sit, which is pretty much the same time every year with 'breaks' for any conceivable holiday resulting in them sitting maybe half the time, and is controversial when 'stuff' is going down and the leader goes ahead w typical break. It would take at the least a majority who could then only pressure the leader unless they vote in a new leader, which has never happened. As with you virtually none of gov't operations in house and senate are written as law which is allowing the current right wingers to do whatever they want whenever they want however they want. Hmmmmm, just like with you.

    if the queen did dismiss the PM, it would set a precedent, and thus wouldn't be surprised if it started the road to abolish the monarchy as future PMs would be weary of it happening to them

    In a BBC Radio-5 interview of August 11, and with reference to the rule of the Supreme Court in the Miller litigation, Ms Rose Slowe LLM (Honorary Research Fellow, University of Bristol Law School, author on EU Law and Barrister at Foundry Chambers) reconfirmed her statement of earlier this year that, unless there is an Act of Parliament authorising a no-deal Brexit, or Brexit on the terms of a withdrawal agreement, legally the United Kingdom will not be leaving the European Union on October 31st and will remain a Member State, on the one hand because a Member State can only leave in accordance with a decision that is taken in compliance with its own constitution, and on the other hand because it would be incompatible with the EU Treaties for Article 50 to have the effect of ejecting a Member State against its will or contrary to its own constitutional requirements. 
    Moreover, she explained that the Article 50 notice issued would lapse and cease to be of effect as it has to be interpreted as being subject to the condition that it would be made effective by an Act of Parliament down the line; it was a conditional notice and if these conditions are not met it would just lapse and the UK would continue to retain its EU membership. Probably this is also the opinion of the EU-27, which explains their relative silence on the prorogation issue.
    It is therefore surprising that everybody is talking about the consequences of a no-deal Brexit when, according to the rule of the Supreme Court in the Miller litigation, legally the UK remains a Member State as long as the UK Parliament did not decide otherwise? Or is the strategy of the PM to “wag the dog” by intentionally attracting the general attention on the prorogation in order to allow him to claim, as from November 1st onwards, that despite the decision of the UK Government to leave the EU the EU continuous to interfere, thus fishing for the votes of the Brexit-party voters in view of a future general election?
