Are You an Indian Citizen?
Most people believe that carrying an Aadhaar, PAN, Passport, Driving Licence, or Voter ID is enough to prove Indian citizenship. Surprisingly, that’s not how the law works.
Here’s what the law actually says:
• Aadhaar Card only proves identity and is not proof of citizenship or nationality.
• PAN Card and Driving Licence are issued for taxation and driving purposes, not to establish citizenship.
• Voter ID gives the right to vote, but courts have clarified that it cannot be treated as conclusive proof of Indian citizenship.
• Passport identifies you as an Indian national for international travel, but citizenship is determined under the Citizenship Act, 1955.
• For people born before 1 July 1987, birth in India is generally sufficient to claim Indian citizenship.
• For those born on or after 1 July 1987, citizenship depends not only on the place of birth but also on the citizenship status of the parents, as prescribed under the Act.
• In cases of naturalisation or registration, the official citizenship certificate issued by the Ministry of Home Affairs serves as the legal proof of Indian citizenship.
Knowing the difference between an identity document and proof of citizenship can help avoid confusion when legal questions arise.
