Nie wykorzystałeś zaległego urlopu? Pracodawca może zdecydować za Ciebie!

Wielu pracowników zakłada, że skoro urlop jest ich prawem, to wyłącznie oni decydują o terminie jego wykorzystania. Jednak w przypadku zaległego urlopu, decyzdujące znaczenie ma art. 168 Kodeksu pracy, zgodnie z którym: urlopu niewykorzystanego w terminie ustalonym zgodnie z art. 163 należy pracownikowi udzielić najpóźniej do dnia 30 września następnego roku kalendarzowego.

Oznacza to, że jeśli pracownik odmawia wykorzystania zaległego urlopu, pracodawca może wyznaczyć termin jego wykorzystania również bez zgody pracownika. Stanowisko to od lat potwierdza również orzecznictwo Sądu Najwyższego: ,,pracodawca może wysłać pracownika na zaległy urlop, nawet gdy ten nie wyraża na to zgody” (wyrok SN z 24.01.2006 r., I PK 124/05).

Pamiętaj! Prawo do urlopu służy przede wszystkim zapewnieniu pracownikowi realnego odpoczynku, dlatego przepisy nie pozwalają na nieograniczone odkładanie urlopu na kolejne lata. 

⚖️ Podstawa prawna:
– art. 168 Kodeksu pracy;
– wyrok Sądu Najwyższego z 24 stycznia 2006 r., I PK 124/05.
